Frequently Asked Questions – Sponsor Licence Applications
Who needs a sponsor licence?
Any UK employer who wishes to recruit a worker from outside the UK and Ireland under the Skilled Worker, Senior or Specialist Worker, Graduate Trainee, Secondment Worker, UK Expansion Worker, or Temporary Worker routes must hold a valid sponsor licence before assigning a certificate of sponsorship.
What types of sponsor licence are available?
The licence covers Worker routes, which include the Skilled Worker route, and Temporary Worker routes, which include roles in the creative, charity, religious, government authorised exchange, and international agreement categories. An employer can apply for both categories at the same time or add categories to an existing licence later.
How long does the application take?
Standard processing takes approximately eight weeks. Priority processing is available for an additional fee and aims to reduce the decision time to around ten working days. We advise on whether priority processing is appropriate given the circumstances of each application.
What documents are needed?
The mandatory supporting documents depend on the type of organisation and the route being applied for. Most applications require evidence of PAYE registration, VAT registration where applicable, insurance, and proof of trading premises. We confirm the exact requirements for each application.
Does the Home Office visit businesses before granting a licence?
The Home Office can carry out a pre-licence compliance visit at any time before a decision is made. Visits are more likely for businesses in sectors regarded as higher risk. We advise on what a visit involves and how to prepare.
What are the key personnel, and who should be appointed?
The Authorising Officer is the most senior person responsible for the licence. The Key Contact handles correspondence with the Home Office. Level 1 and Level 2 Users operate the sponsorship management system. The Home Office will check the suitability of those named, and any adverse immigration or criminal history needs to be considered before appointments are finalised.
Can a small business apply for a sponsor licence?
Yes, there is no minimum size of business for an application. Start-ups, sole traders who operate through a company structure, and businesses with a small number of employees can all apply. The assessment focuses on whether the business is genuine, lawfully operating, and capable of meeting its sponsorship duties.
What happens if the Home Office asks for more information after submission?
The Home Office may issue a request for further information during the assessment period. The deadline for responding is fixed and short. A failure to respond in time or a response that does not address the request will result in a refusal.
Can a business apply if it has previously had a licence refused or revoked?
Yes, in some circumstances. Whether a fresh application is viable depends on the grounds for the earlier refusal or revocation and how much time has passed. In some cases, a cooling-off period applies before a new application can be made.
What is the sponsorship management system?
The sponsorship management system is the Home Office online portal through which licensed sponsors assign and revoke certificates of sponsorship, report changes in a sponsored worker’s circumstances, and manage their licence. Level 1 Users have full access. Level 2 Users have limited access.
Can a licence cover workers in more than one location?
Yes, a single licence can cover workers employed across multiple sites in the UK. The licence and the certificate of sponsorship must reflect the location or locations where the worker will actually work. Remote and hybrid working arrangements must be reported correctly.
