Frequently Asked Questions – British Citizenship
How long do I need to have lived in the UK before applying?
Standard applicants must have been lawfully resident in the UK for at least five years before the application date and must have held ILR or Settled Status for at least twelve months. Spouses and civil partners of British citizens can apply after three years of lawful residence without the twelve-month ILR wait. During the five-year period you must not have spent more than 450 days outside the UK in total, or more than 90 days in the final twelve months.
What is the good character requirement for citizenship?
The good character assessment for citizenship is stricter than for ILR. The Home Office considers criminal convictions in the UK and overseas, immigration breaches including historic overstays, unpaid taxes, and whether previous applications to the Home Office were honest. Matters spent under domestic rehabilitation rules can still be relevant for citizenship purposes. We advise on how any issue in your history is likely to be assessed before you apply.
What is the Life in the UK test?
The Life in the UK test is a multiple-choice assessment that must be passed at an approved test centre before applying. It covers British history, government, laws, and customs. Most applicants between eighteen and sixty-four are required to take it. Exemptions apply based on age and certain medical conditions. We can confirm whether an exemption applies to you.
Can I hold dual nationality as a British citizen?
The UK permits dual nationality. Holding British citizenship does not require you to give up your existing nationality. However, some countries treat naturalisation elsewhere as automatic renunciation of their citizenship. We advise clients on the dual nationality rules of their home country before they apply, so the implications are fully understood.
My child was born in the UK. Are they automatically British?
A child born in the UK is not automatically a British citizen unless at least one parent was either a British citizen or settled in the UK at the time of the birth. Children born here who are not automatically citizens may be eligible to register as British after living in the UK for ten years. We advise on the options available to children across a range of circumstances.
Can I apply if I have a criminal conviction?
A conviction does not automatically prevent a citizenship application, but the impact depends on the nature of the offence and the sentence received. A custodial sentence of twelve months or more will generally lead to refusal. Less serious convictions are assessed on the full circumstances. We advise clients honestly on the likely outcome before they submit.
What does the application cost?
The current fee for a naturalisation application exceeds £1,500 per adult and is non-refundable if refused. There is no priority service available. We advise clients on the full cost of the process, including the citizenship ceremony fee and the cost of a British passport.
How long does the application take?
The Home Office aims to process most naturalisation applications within around six months, though delays are common. Once approved, you will be invited to a citizenship ceremony, which must take place before the certificate is issued.
Can I apply on the basis of a British parent?
If a parent was a British citizen at the time of your birth, you may already hold British citizenship without needing to apply. The rules become more complex for grandchildren and for those born in certain overseas territories. We advise on whether you already hold citizenship and what evidence is needed to obtain a British passport.
