Frequently Asked Questions – Surgical Negligence Claims

What is the difference between a surgical complication and surgical negligence?

A surgical complication is a recognised risk of an operation that can occur even with entirely competent surgery, while surgical negligence is an error that fell below the standard a reasonably competent surgeon would have met. The distinction depends on independent expert evidence assessing exactly what happened during your operation against what a competent surgeon in that specialty would have done. Not every poor outcome from surgery is the result of negligence, which is why a detailed medical record review is essential before a claim proceeds.

Can I claim if I was not warned about a risk that later happened?

Yes, if the risk that materialised was one that a reasonable patient in your position would have considered significant, and you were not warned about it, you may have a claim even if the surgery itself was correctly performed. Failing to disclose a material risk is itself a breach of duty, separate from any technical error during the procedure, and you would also need to show that, had you been warned, you would probably have chosen a different course of treatment.

How long do I have to bring a surgical negligence claim?

A claim must generally be brought within three years of the date of the operation or the date you knew, or reasonably should have known, that your harm resulted from negligence, under section 11 of the Limitation Act 1980. This date can be later than the operation itself, particularly where the full extent of an injury only becomes apparent during recovery.

What compensation is available for surgical negligence?

Compensation covers general damages for pain, suffering and loss of amenity, and special damages for financial losses such as further corrective treatment, lost earnings, and care costs where the injury has lasting effects. Where the negligence caused permanent disfigurement or disability, compensation reflects the lifelong impact on your daily life and future earning capacity. Do I need a second surgery to fix the harm caused?

Not always, since some surgical negligence claims relate to harm that cannot be corrected by further surgery, such as nerve damage or scarring. Where corrective surgery is needed, the cost of that treatment, whether on the NHS or privately, forms part of your claim.
