How does divorce work in England and Wales?
Since 6th April 2022, divorce in England and Wales has been available on a no-fault basis under the Divorce, Dissolution and Separation Act 2020. Neither spouse needs to prove that the other has behaved badly or that they have lived apart for any set period. One or both parties can apply to the court stating that the marriage has broken down irretrievably. There is a minimum 20-week period between the application and the Conditional Order, and a further six weeks before the Final Order can be applied for. The whole process takes at least 26 weeks.
Do I need to go to court to get divorced?
In most cases, the divorce is processed without either party appearing in court. The court makes the Conditional Order and Final Order on the papers. Court hearings are more commonly required when the financial arrangements are disputed and cannot be resolved by negotiation or mediation.
What is the difference between a divorce and a financial settlement?
The divorce ends the legal status of the marriage under the Matrimonial Causes Act 1973. It does not automatically resolve the financial claims that each spouse has against the other. Those claims must be dealt with separately, either by agreement recorded in a consent order or by contested financial remedy proceedings. It is generally advisable to resolve financial matters at the same time as, or before, obtaining the Final Order.
Can I apply for a divorce without a solicitor?
Yes, it is legally possible to apply for divorce without a solicitor, particularly where the divorce itself is uncontested. The financial settlement is a separate and more complex matter. Agreeing on finances without legal advice carries real risk, particularly where pensions, property, or business interests are involved. A consent order made without proper advice may not achieve its intended purpose, and it is very difficult to reopen once approved by the court.
How long does a divorce take?
The divorce itself takes at least 26 weeks. Where financial remedy proceedings are required, the overall process typically takes longer: from several months for a negotiated settlement to a year or more for contested proceedings that go to a final hearing.
What financial orders can a court make on divorce?
The court has broad powers under the Matrimonial Causes Act 1973 to make financial orders in divorce cases. Those orders can cover the transfer or sale of property, lump sum payments, spousal maintenance, pension sharing, and other financial arrangements. The court’s starting point is fairness, assessed in light of all the circumstances of the marriage.
What happens to the family home when we divorce?
The family home is usually the most significant asset in a divorce. The court can order it to be sold, with the proceeds divided, transferred to one party in exchange for a lump sum or pension share, or retained for one party to live in for a period, for example, until the children finish their education. The right outcome depends on the specific circumstances, including what other assets are available and what each party needs.
