Frequently Asked Questions – Immigration Appeals
When do I have a right of appeal?
The right to appeal to the First-tier Tribunal is available where the Home Office refuses a human rights or protection claim, revokes protection status, makes a deportation order, or refuses or revokes a permit under the EU Settlement Scheme. Most straightforward visa refusals in work and visit categories do not carry an appeal right. The right to appeal is governed by the Nationality, Immigration and Asylum Act 2002. We can confirm whether your refusal carries a right of appeal.
How long do I have to appeal?
If you are in the UK, the deadline is 14 calendar days from the date the decision notice was sent. Outside the UK, you have 28 calendar days. These limits are strict and extensions require good reasons. If you have missed the deadline, take advice promptly on whether an out-of-time application is likely to be accepted.
What happens at a First-tier Tribunal hearing?
Both sides present evidence and submissions to an immigration judge. Witnesses can be called and cross-examined. The Home Office presenting officer argues that the original decision was correct. Your representative presents the evidence, questions witnesses, and makes submissions on why the appeal should succeed. Written reasons are issued within a few weeks of the hearing.
What are grounds of appeal?
Grounds of appeal identify the legal basis on which you argue the Home Office decision was wrong. An appeal against refusal of a human rights claim can be brought on the ground that the decision is unlawful under the Human Rights Act 1998. A protection appeal can be brought on the grounds that removal would breach the Refugee Convention, humanitarian protection obligations, or the Human Rights Act. We identify the applicable grounds and draft them precisely.
What goes into an appeal bundle?
A thorough appeal bundle contains witness statements from the appellant and supporting witnesses, documentary evidence of the relationship or circumstances relied on, current country evidence from credible sources, medical or expert evidence where relevant, and applicable legal authorities. The bundle must be paginated, indexed, and served on the tribunal and the Home Office before the hearing date.
Can I appeal if my claim was certified as clearly unfounded?
Certification removes the in-country right of appeal. You must leave the UK before pursuing the appeal. The appeal itself proceeds in the same way as an in-country appeal, but from overseas. Where a certification is arguably unlawful, judicial review may be available to challenge it before removal takes place. We advise on whether that argument is available in your case.
What is the Upper Tribunal?
The Upper Tribunal (Immigration and Asylum Chamber) hears appeals against First-tier Tribunal decisions on points of law. To reach the Upper Tribunal, permission must first be sought from the First-tier Tribunal. If refused there, permission can be sought directly from the Upper Tribunal. The Upper Tribunal can only consider legal errors in the First-tier decision, not whether a different factual outcome was preferable.
What happens if my appeal is dismissed?
A dismissed appeal should be reviewed to identify whether a legal error was made in the determination. If there is a clear error of law, permission to appeal to the Upper Tribunal can be sought. If the determination is legally sound, making further submissions to the Home Office with new evidence may be worth exploring depending on the circumstances.
Can I represent myself at the tribunal?
You are entitled to represent yourself, but immigration appeals are formal legal proceedings with strict procedural rules and a Home Office representative arguing against you. Preparing a proper bundle, drafting legal submissions, and cross-examining witnesses requires legal knowledge and experience. Most clients who appear without representation are at a real disadvantage. We advise on the benefits of representation before any client decides to proceed alone.
