Frequently Asked Questions – Immigration Bail
Why has my family member been detained?
Immigration detention is used where the Home Office believes a person is liable to removal and poses a risk of absconding, or where detention is considered necessary to facilitate removal. People are detained at ports of entry, at reporting appointments, after release from prison, and during enforcement operations. Detention is an administrative measure, not a punishment. Its lawfulness can be challenged.
How do I apply for immigration bail?
An application for bail is made on Form B1 and submitted to the First-tier Tribunal. It sets out the grounds for release, the proposed bail address, and any proposed conditions. The Home Office responds with its reasons for opposing bail, and an immigration judge decides the application at a hearing. We prepare and submit bail applications and represent clients at hearings.
What are bail conditions?
Bail conditions may include a requirement to live at a specified address, to report regularly to a Home Office reporting centre, restrictions on travel, and in some cases electronic monitoring. The conditions must be proportionate to the circumstances. We advise on the conditions likely to be imposed and ensure the proposed bail address and surety arrangements are presented as effectively as possible.
What is a surety?
A surety is a person, typically a family member or close friend settled in the UK, who agrees to pay a specified sum to the Home Office if the person on bail fails to comply with their bail conditions. The tribunal considers the surety’s financial means and their relationship to the detainee. We advise proposed sureties on what is required and prepare their supporting evidence.
Can detention be challenged in court?
Yes. If the detention is unlawful, for example because there is no realistic prospect of removal within a reasonable time or the correct procedure was not followed, it can be challenged by judicial review in the Upper Tribunal or by habeas corpus in the High Court. A successful challenge results in immediate release. We assess lawfulness in every case we are instructed on.
How long can someone be detained?
There is no statutory maximum period of immigration detention in the UK. A person can be held for weeks or months. The longer the detention continues without removal being imminent, the stronger the argument that it has become unlawful. Courts have consistently held that detention requires a realistic prospect of removal within a reasonable time.
Can an asylum seeker be detained?
Yes, though asylum seekers are entitled to additional protections. The Home Office’s own policy restricts detention of asylum seekers unless specific reasons apply. Particular protections exist for vulnerable individuals, including victims of trafficking or torture, whose detention may be unlawful in any circumstances. We advise on the protections that apply in each case.
What happens if bail is refused?
If bail is refused, the detainee remains in the removal centre. A further application can be made as circumstances change, for example if the underlying removal case weakens or the delay in removal has become more significant. We review refusal decisions and advise on when a further application is appropriate.
Can I visit a detained family member?
Visiting arrangements vary by removal centre. Most centres permit family visits during set hours. Contact the specific centre directly for details. We advise families who are unsure of their rights and who want to understand the process and how best to support their detained relative.
