Following changes effective from March 2026, the duty to deport was extended to foreign nationals who receive a suspended sentence of twelve months or more. When does the Home Office have a duty to deport?
The Home Office has a duty to deport any foreign national who has been sentenced to at least twelve months’ imprisonment in the UK, unless an exception applies. Following amendments effective from March 2026, that duty extends to foreign nationals who receive a suspended sentence of twelve months or more. These provisions derive from the UK Borders Act 2007 and Part 13 of the Immigration Rules. The duty can be rebutted only where a specific exception is established.
What are the exceptions to deportation?
The main exceptions apply where deportation would be unduly harsh on a qualifying partner or qualifying child in the UK, or where the foreign national has lived in the UK for most of their life, is socially and culturally integrated, and would face very significant obstacles to reintegration in the country of return. For those sentenced to four years or more, only very compelling circumstances will suffice. We advise on which exception, if any, applies to your case.
What does deport now, appeal later mean?
Deport now, appeal later is a procedure under which the Home Office certifies a case so that the person must leave the UK before pursuing their appeal. It is commonly used in foreign national offender cases where the Home Office considers the human rights claim clearly unfounded. The person can still appeal from overseas, but they must leave first.
Can family life prevent deportation?
A genuine and subsisting relationship with a qualifying partner or child in the UK can form the basis of an exception to deportation, but the threshold is demanding. The question is whether the effect on the partner or child would be unduly harsh if deportation proceeds. This requires careful, specific evidence from the family members themselves about the practical reality of the relationship and the impact of separation.
What is a deportation order?
A deportation order is a formal legal instrument requiring a person to leave the UK and prohibiting their return. Once signed, it is recorded by the Home Office and will be relevant to any future application to enter the UK. The person cannot return without first applying for revocation of the order.
Can a deportation order be revoked?
Yes, in certain circumstances. The Home Office can revoke a deportation order if it is satisfied that the reasons for making it no longer apply, typically after a significant period abroad and a genuine change in circumstances. Applications for revocation are assessed individually. We advise on whether an application is likely to succeed and how to present it.
What if I have lived here most of my life?
Long residence and deep integration in the UK are factors the Home Office and the tribunal must consider when assessing whether deportation is proportionate. Where a person has spent most of their life in the UK, is socially and culturally integrated, and would face very significant obstacles to life in the country of return, there may be a strong basis to resist deportation. The strength of the case depends on the length of residence, the depth of ties, and the nature of the offending.
Do I have a right of appeal against deportation?
In most cases, yes. An appeal to the First-tier Tribunal against a deportation order is available. However, the Home Office may certify the appeal so that it must be pursued from outside the UK using the deport now, appeal later procedure. Where an in-country appeal is available, the order is normally suspended while the appeal is pending.
What happens to my family if I am deported?
Family members in the UK are not automatically required to leave if you are deported. Their immigration status continues independently of yours. Their circumstances and the impact of your deportation on them form part of the assessment of whether deportation is proportionate. We advise families on their own immigration positions and how to protect them during deportation proceedings.
