Frequently Asked Questions – UK Unmarried Partner Visa
What is the two-year cohabitation requirement?
You and your UK-based partner must have been living together in a relationship similar to marriage or civil partnership for at least two years before the application date. The relationship must be genuine and subsisting, and you must both intend to live together permanently in the UK. Periods of living apart due to work or study do not automatically disqualify you, but the circumstances must be explained and evidenced.
What evidence is needed to prove cohabitation?
The Home Office expects a consistent documentary record of two people sharing a life at the same address. Bank statements, tenancy agreements, utility bills, correspondence to both parties at the shared address, and personal statements from each partner all count. We advise on the specific evidence available in your situation and how to address any gaps.
Can I work in the UK on an unmarried partner visa?
Yes, there is no restriction on working or self-employment as an unmarried partner. You can start work from the date you arrive. The visa carries a no recourse to public funds condition, but working rights are unrestricted.
What is the financial requirement?
The minimum gross annual income threshold is £29,000 for applications made on or after 11 April 2024. The figure is assessed primarily by reference to the UK sponsor’s earnings. We review the financial position at the outset and advise on how to present the evidence correctly.
How long is the initial visa?
Entry clearance as an unmarried partner is granted for up to 33 months. You will need to apply for an extension before that period expires. After a total of five years in this category, you can apply for Indefinite Leave to Remain, provided the relationship continues and the other requirements are met.
What if the application is refused?
A refusal notice will set out the specific reasons for the decision. Depending on those reasons, you may have a right of appeal or a fresh application with additional evidence may be the faster route. We advise on the most appropriate next step for your circumstances.
Can I apply if my UK partner has Pre-Settled Status?
The rules for unmarried partners of EEA nationals with Pre-Settled Status are more complex. Depending on when your partner arrived in the UK and when the relationship started, you may be able to apply under the EU Settlement Scheme as a family member. We advise on the correct route.
Can we apply if we are not currently living together?
An application may still be possible if the separation was caused by work, study, or cultural factors and you can show the relationship is genuine and that you have met the cohabitation requirement in the past. The circumstances need a clear explanation and supporting evidence.
What happens after ILR is granted?
Once you hold Indefinite Leave to Remain, you can live and work in the UK without immigration restrictions. After twelve months of ILR, you can apply for British citizenship by naturalisation, subject to the residency, language, and good character requirements.
