What is the financial requirement for a spouse visa?
You and your UK-based partner must show a minimum gross annual income of £29,000 for applications made on or after 11 April 2024. If transitional arrangements apply, the earlier threshold of £18,600 may still be relevant. Income from employment, self-employment, pension, and certain savings can count, but the Home Office has specific rules on how each source must be evidenced. What documents do I need?
Core documents include valid passports for both parties, evidence of a genuine and subsisting relationship, proof that the financial requirement is met, evidence of adequate accommodation in the UK, and proof of English language ability. How long does the application take?
Processing times for entry clearance applications vary by country. Standard decisions typically take between eight and twelve weeks, though times can be longer. Priority and super-priority services are available at some overseas centres for an additional fee. We advise on which options are open from the country you are applying from.
What happens after the visa is granted?
An initial spouse or civil partnership visa is usually granted for 33 months. You will need to apply for an extension before it expires. After a total of five years in this category, you can apply for Indefinite Leave to Remain, provided the relationship is still genuine and the other requirements are satisfied at that stage.
Can I work on a spouse visa?
Yes, there is no restriction on working in the UK on a spouse or civil partnership visa. You can take up employment, self-employment, or study without separate permission. The visa carries a no recourse to public funds condition, meaning most means-tested benefits are unavailable, but working rights are unrestricted.
What if my application is refused?
Depending on the circumstances, a refusal may carry a right of appeal to the First-tier Tribunal, or you may be able to request an administrative review. In some cases, a fresh application with stronger evidence is faster. We advise on the best option based on the specific reason for refusal.
Can I apply if my partner is a settled EU national?
Yes. A partner who holds Settled Status under the EU Settlement Scheme can sponsor a spouse or civil partnership visa application under the standard partner route. The same financial, relationship, and language requirements apply. If your partner holds Pre-Settled Status, different rules may apply depending on their date of arrival.
Do I need to take an English language test?
For an initial entry clearance application you must demonstrate English language ability at level A1. For the extension after 30 months, level A2 is required. You can satisfy this through a Secure English Language Test, a degree taught in English, or being a national of a majority English-speaking country. Age and medical exemptions also apply.
What is the accommodation requirement?
The application must show that both partners will have adequate accommodation in the UK without recourse to public funds. The property must not be overcrowded and must meet basic health and safety standards. Evidence typically includes a tenancy agreement or mortgage statement and, where required, a letter from the property owner.
